Maryland Natural Resources Police and the U.S. Coast Guard do not need a reason to board your vessel and many BUI/BWI cases begin as part of a routine inspection. Many of the field sobriety tests that are used on land have little or no validity on boaters whose "sea legs" affect their balance and equilibrium. New water-based sobriety tests are starting to be used, but marine police may have very little experience in administering these new tests correctly. In short, you may have defenses to your BUI/BWI case that an experienced criminal defense attorney can present.

Penalties for BUI/BWI

Boaters can be asked to take a breath test and, like Maryland's DUI per se law, a test result of with a blood alcohol concentration of 0.08% or higher will result in a charge of "BUI per se." A first offense carries penalties of up to one year in jail, a $1,000 fine and the loss of your boating privileges in the State of Maryland for up to one year. The results of your breath test for a boating offense do not affect your license to drive a motor vehicle.
