starting to be used, but marine police may have very little experience

Penalties for BUI/BWI
Boaters can be asked to take a breath test and, like Maryland's DUI
per se law, a test result of with a blood alcohol concentration of 0.08
or higher will result in a charge of "BUI per se." A first offense
carries penalties of up to one year in jail, a $1,000 fine and the loss
of your boating privileges in the State of Maryland for up to 1 year.
The results of your breath test for a boating offense do not affect your
license to drive a motor vehicle.
